From: A.J.L. de Breed [debreed@debreed.nl] Sent: Sunday, November 05, 2000 5:56 PM To: reconsider@icann.org Cc: Caspar.Wenckebach@bdn.nl Subject: request for reconsideration Formal request for reconsideration: - requested party: De Breed Holding B.V., Baronielaan 184, 4837 BE Breda, The Netherlands, tel: intl-31-76-5654321, fax: intl-31-76-5654283 - concerns: the refusal by ICANN for not willing to consider the application for new Top Level Domains on grounds that the application was not accompagnied by a $ 50,000 but by a $ 1,000 check made out to ICANN. - time and day of action: an e-mail from Lisa Polanski made on October 6, 2000 at 5:29 Central European Time - affected by the action: application will not be considered at all and therefore is not placed on website for public review and comment the next phase after submission in the contest for granting a new TLD - request for a temporary stay of the action: yes - specific steps to tak by ICANN: the application to be included in the following steps of the review process so that it will be judged by the board of ICANN - grounds on the which action should be reversed: The refusal mail states that a $ 50,000 check is a must and completely ignores the fact that commitment was made to pay all additional costs and expenses incurred by ICANN in relation to the review of the application. A one-sided non-substantiated demand for $ 50,000 non-refundable fee for PERMISSION to submit an application to a public organisation for an on public grounds decided grnating is unjust - documents to submit: see cover letter of the application and the e-mails of my legal counsel.
