Cross-Community Session: GDPR & WHOIS Compliance Models #

The General Data Protection Regulation (GDPR) adopted by the European Union (EU) takes effect in May-2018. The GDPR applies to all companies processing personal data of subjects residing in the European Union, regardless of the company's location.

ICANN executives, subject matter experts from various departments, and Board members are guiding the organization's activities related to the GDPR. In Nov-2017, ICANN org began a process to develop an Interim Model for Contractual Compliance with Registry and Registrar Agreements.

ICANN org acknowledges the interim model will not replace multistakeholder policy development and implementation activities, including: privacy & proxy services; the procedure for Whois conflicts with Privacy Law; and development of a new policy framework for registration directory services (RDS).
On 28-Feb ICANN published its proposed Interim Model. ICANN org is now seeking comment on the Proposed Interim Model, from the ICANN community and from European Data Protection Authorities.
