A Tale of TWO CITIES? TWO ORGANISATIONS?

Problem: Someone or somehow our domain names are hijacked and transferred without our permission to another registrar and we lose control and ownership!

CITY ONE: ICANN
Issue:
1. Losing Registrar does not want to know! Nothing to do with us GOV! (UK expression).

2. New Registrar says he can't do anything unless a Dispute Transfer is initiated by the Losing Registrar who of course denies all responsbility and says contact ICANN

3. ICANN - ICANN WHO? Oh yes - raise a ticket number, wait for a response or lack of a response and...nothing happens......informal advise is to take legal action! Great Advice - THANK YOU MR ICANN

A SAD ENDING

and on the othe side of the pond.....

CITY TWO: NOMINET
Issue: AS ABOVE
Solution: NOMINET takes 7 DAYS to verify transfer was done without our permission, that we are the legal owners and hey presto - all the co.uk names transferred within 2 days..........A HAPPY ENDING!

Moral of the Story?
Stick to NOMINET - you have a degree of protection.
ICANN - - well in the UK they would be classified as not fit for purpose and probably on BBC's programme called WATCHDOG. You get better regulation in any other industry other than domain names!

and the CURRENT STATUS :-

Stalemate!

Can someone help? How do we get the old registrar to provide us with the evidence of who authorised the transfer to take place? How do we get the names transfered back to the old registrar? In any other industry, what happened is pure theft and fraud...but in the ICANN world...well I am not sure!
