I am fully familiar with ICANN's technical
and administrative responsibilities, having
explained ICANN and the Domain Name system
to no fewer than ten different courts in the
United States over the past two years, and
having remained in communication with several
active ICANN participants (e.g., Dianne Cabell,
Esther Dyson) via mailing lists devoted to
issues of Internet law and public policy.
My leadership and policy-level roles include
active participation in the American Bar
Association, including giving lectures
through the ABA concerning Internet issues
(trademarks, privacy, electronic payments,
encryption), my prior work for the United
States Department of Justice, my prior
testimony to legislative committees on
Internet issues when I was an Associate
attorney at the Washington, D.C. law firm
of Steptoe & Johnson, and contributions to
other organizations interested in emerging
Internet issues (American Trial Lawyers'
Association, for example).

I represent and advise clients in the US and
elsewhere about many different Interent issues,
including domain name issues. These clients
include a broad cross-section of Internet stakeholders,
including both trademark owners and domain
name registrants.
(2) Ownership or investment interests
None that I know of.
(3) Official positions in ICANN-related businesses or organizations
None.

BACKGROUND |

I am committed to establishing free
and open democratic institutions, both for
Internet governance, and for other forms of
transnational governance (e.g., establishment
of trade-governing bodies that pay
appropriate attention to issues of the
environment, protection of workers, and the
fair and equitable distribution of wealth
and power worldwide).
As an attorney, for several years I
have developed a specialty in Internet-
related legal issues (including privacy,
intellectual property, encryption,
electronic commerce, First Amendment and
other key issues) and have written and
spoken on all of these subjects.
My clents represent a broad cross-section
of Internet stakeholders, from domain name
registrants falsely accused of
"cybersquatting," to trademark owners who
have the right to shut down clearly
inappropriate use of their trademarks
(for example, I was even ahead of Compuserve
and America Online in beating Internet
"Spam King" Sanford Wallace in litigation
on behalf of a trademark client), to local
communities who are fighting against the
imposition of censorship in their schools
and libraries. I represent both big and
small companies, as well as many individuals.
At present, large and powerful
commercial interests are heavily
over-represented within ICANN's governing
bodies. This over-representation has been
the direct and proximate cause of misguided
policies that promote the perceived interests
of a chosen few, at the expense of the
legitimate interests of the broader Internet
community as a whole. My goal as an at-large
member of the ICANN board will be to prompte
and preserve democratic ideals, and to
ensure that the interests of all Internet
stakeholders are properly reflected in the
ultimate policies developed by ICANN. Let
me reiterate -- it is not enough for ICANN
to say "we listened to the little person,"
but then to ignore his or her interests in
the formulation of policy. The ultimate
policies themselves MUST be formulated
through an open and transparent process, and
MUST in their final form appropriately
protect and promote the democratic ideals
of the broader Interent community.
