BYLAWS REVISION: Art VI, Sect 4: Eligibility
Article VI, Section 4. ELIGIBILITY
No person shall serve simultaneously as (i) a member of any Supporting
Organization Council or other body
that is directly responsible for the selection of Directors by that
Supporting Organization and (ii) a Director.
If a member of any such Supporting Organization Council or such other body
accepts a nomination to be
considered to serve on the Board, such member shall not, following such
nomination, participate in any
discussion of, or vote by, such Supporting Organization Council or other
body relating to the selection of
Directors by such Council or other body.

My comment:
It is obvious that no member of an SO Council should simultaneouly serve on
the ICANN Board or participate in board voting discussions as a Council
member.
However, the scenario of a Council member receiving a Board nomination begs
further exploration.
Suppose most of the Names Council members received Board nominations, thus
requiring they recuse themselves from the Board selection. That would
leave the Names Council bereft of decision makers. Or the constituencies
would vote for replacements in the middle of the ICANN board elections.
This seems both disruptive and disingenuous.
The easy solution is simply to say that SO Council members are not eligible
to be nominated for the ICANN Board during their terms. Let us assume that
among the DNS community there are enough qualified individuals that Board
nominations do not need to draw from the Council pool.
Thus, I submit the following change in the text covering eligibility
qualifications:
DRAFT CHANGE: Article VI, Section 4. ELIGIBILITY
No person shall serve simultaneously as (i) a member of any Supporting
Organization Council or other body
that is directly responsible for the selection of Directors by that
Supporting Organization and (ii) a Director.
No member of any such Supporting Organization Council or such other body
may accept a nomination to be
considered to serve on the Board.
