If we need .EU at all (which I am not really convinced of yet), it should definitely be open for all Europeans.

A lot of issues have to be solved before .EU can be created as a TLD. If it is established I think the answer to your question has to be decided by the EU Commission itself or the TLD manager for the .EU Registry. The internal policy for .EU is not an issue for ICANN as long as it is according to RFC 1591. I have heard that as a start .EU will be for entities within the EU member states only, but later it may be expanded for other countries within Europe. And I think this is acceptable.

I fully support the creation of a new TLD .eu, that will contribute to the development of Internet in Europe: the use of .eu would give a new visibility to European businesses and to the european values and cultures. The conditions of attribution should foster a trusted electronic market and therefore favor the development of e-commerce in Europe.
For the time being it is an initiative of the European Union (Commission and state members). As soon as .eu will be implemented, the Commission has announced that it will undertake contacts to enlarge the scope of this initiative to other european countries.
