Question: How does the ICANN expect to deal with the abusive registration of domain names in several gTLD's (such as already exists in trademark law) if no control is exercised upon the applicants (that could register in every gTLD and prevent the DNS to be efficient) ?

The UDRP is one possible tool to handle trademark conflicts. But there is no global law or policy that would be necessary for a control of registration. Therefore only the nations itself have the power and hopefully the laws that prevent a misuse.

Issues like bad faith and abuse are beyond ICANN's scope. ICANN's job is to administrate names and number spaces. Tasks that can be dealt with elsewhere should be delegated either to local bodies or other supranational institutions.

The naming policy for each TLD will describe if there are some restrictions on who can register. ICANN cannot and should not hinder a company to register under each and every TLD if they want to, but ICANN can and should decide the policy for registration of TLDs (the policy for the root).
