Question: Wouldn't it be worth trying to create third level domains according to the Nice Agreement and require from the applicant certain files (such as exists in France) to prevent some conflicts with trademarks ?

This might be the approach in some of the new TLDs. I personally support chartered TLDs in order to have a clear possibility to avoid trademark conflicts.

Trademarks are only the tip of the iceberg. The DNS was never meant to reflect trademarks and real names. The DNS is not and will never be sophisticated enough to locate all people, organizations and products which, in principle, have a right to a specific name. Third level domains wouldn't solve this problem. Only a directory system can. In my view, the conflict between trademarks and domain names won't get us anywhere but to a dead end.

This is part of the coming discussions and negotiations regarding the gTLD applications. A naming policy for a TLD *may* also say something about third level domains. This is often the case in ccTLDs, but I am not sure if this is useful for gTLDs.
