Question:
Regarding ICANN's Advisory of 24/9, what additional safeguards do you propose to prevent (ab)use of our personal data (domain registrations) for further purposes? [Including by Registrars as well as by parasites like Verio]

As shown in the Register.com v. Verio case, there are already safeguards to protect the privacy of data in the Icann's registrar agreements. I think that it is a very important issue, that Icann needs to carefuly monitor and on which Icann should take new actions if necessary.

In my view, the protection of privacy and the availability of contact information on domain names holders form conflicting goals both of which need to be met somehow. As I have pointed out elsewhere on the q&a forum, I object to the Intellectual Property constitution's demand for a centralized whois database.
While I think that each registry should draw up its own name policy, I'd hope that all registries do agree on the principle that commercial uses of domain name holder's information should be generally excluded.
Just as an aside, the Privacy Commission Act failed in the US congress today.

The serious TLD managers protecting their Registrants (customers) should in their naming policy have a sentence taking care of this. Example from the naming policy for .no (ccTLD), under Legal Aspects: **7.1 The registered information for each domain registered under .no will be made openly available on the Internet. This will be done by registering the domain and the contact persons in NORID's Whois-database. Accessibility will also be given through other Internet technologies. The intention is that this shall function as an aid in solving eventual problems related to the domain. Commercial use of the registered information, such as goal-oriented marketing or similar, is forbidden.**
