Topic: Use of TLDs

Question: Will new TLDs provide a larger version of the com/org/net problem? Should ICANN encourage many holders of ABC in different TLDs or to let the biggest or first company named ABC have the name across all relevant TLDs? How can this be influenced by ICANN?

This is a complex issue and one of the major reasons the TLD space should be opened on a deliberate basis. At issue really is users' expectations. The trademark issues are complex. Mechanisms for dispute resolution and the like must be developed that allows the new spaces to be opened without spawning litigation or implicitly encouraging squatting/speculation.

If this is a problem, it is a problem caused by trademark law. I don't believe ICANN is the appropriate body to influence trademark law. Let the law worry about cleaning up itself; ICANN has enough to worry about without worrying about gaming the law.

ICANN should generally not involve itself with preferences in the initial registration of domain names, but should provide a fair dispute resolution system. If ICANN does not do dispute resolution, you'll see strange jurisdiction rules develop with courts and policy battles among national governments over domain disputes. But a better ICANN dispute resolution system than we have now needs to be put in place.
